Terms of Service

By accessing or using the DevOps AI platform ("Service") provided by RainTech, Inc. ("RainTech," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

DevOps AI is an AI-orchestrated managed service provider (MSP) control plane deployed via Microsoft Azure Marketplace. The Service includes 15 operational zones, 157 process areas, and AI-assisted automation capabilities with human-in-the-loop controls.

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activity under your account

The Service is available through Azure Marketplace on a subscription basis. Pricing, billing cycles, and payment terms are as specified in your Azure Marketplace subscription agreement and our pricing page. RainTech reserves the right to modify pricing with 30 days' notice.

You retain all rights to your data. DevOps AI deploys to your Azure subscription, and your data remains in your tenant at all times. RainTech does not access, process, or store your operational data outside your Azure environment. You are responsible for compliance with applicable data protection laws.

You agree to use the Service in accordance with our Acceptable Use Policy and all applicable laws. You shall not use the Service to engage in any unlawful, harmful, or fraudulent activity.

RainTech retains all intellectual property rights in the Service, including software, algorithms, AI models, documentation, and trademarks. Your subscription grants a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAINTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Either party may terminate the subscription with 30 days' written notice. RainTech may suspend or terminate access immediately if you violate these Terms. Upon termination, your data remains in your Azure tenant — RainTech does not delete customer data.

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in El Paso County, Colorado.
